Terms of Use

These Terms of Use ("Terms") govern your access to and use of The SOS App ("the App"), operated by The Drone Wave LLC, doing business as Scintilla Dev ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Purpose of the App

The SOS App is a supplementary personal safety tool designed to help users share their location with trusted contacts. It is NOT a replacement for emergency services. In any life‑threatening situation, you must call your local emergency number immediately.

2. Eligibility

You must be at least 16 years old (or the minimum age required in your region) to use the App.

3. User Account

To use certain features, you may need to create an account using email and password, Google Sign‑In, or other supported authentication providers.

You agree to provide accurate information, keep your login credentials secure, and be responsible for all activity under your account.

We may suspend or terminate accounts that violate these Terms.

4. User Responsibilities

By using the App, you agree that:

• You are solely responsible for your own safety
• You will not rely exclusively on the App during emergencies
• You will maintain a charged, functioning device
• You will ensure your emergency contacts and family members consent to receiving alerts and location data
• You will comply with all applicable laws

5. Technology Limitations

The App depends on GPS, mobile networks, device sensors, and third‑party services. These may fail, be inaccurate, or become unavailable without notice.

The App may not function properly due to:

• Weak or unavailable GPS signal
• No mobile or internet connectivity
• Battery depletion or device shutdown
• Operating system restrictions
• Hardware or software malfunctions
• Third‑party outages (Firebase, Supabase, Mapbox, etc.)

We do not guarantee continuous or error‑free operation.

6. No Emergency Service

The App does not contact emergency services and cannot guarantee that your contacts will receive alerts. You must always call emergency services directly when in danger.

7. Consent to Share Location

By using the App, you authorize us to collect your real‑time GPS location when SOS tracking or family sharing is active, transmit your location to your selected contacts, and store location history as required for App functionality.

You are responsible for ensuring your contacts consent to receiving your information.

8. Family Connections

Adding a family member requires mutual consent. Either party may remove the connection at any time, which immediately stops location sharing.

9. Prohibited Conduct

You agree not to:

• Use the App for unlawful, harmful, or abusive purposes
• Stalk, harass, or improperly track others
• Misuse location‑sharing features
• Attempt to reverse engineer, modify, or disrupt the App
• Impersonate others or provide false information

10. Intellectual Property

All content, branding, software, and features of the App are owned by The Drone Wave LLC or its licensors.

11. "AS IS" Disclaimer

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

We do not guarantee:

• Accuracy of GPS data
• Delivery of alerts
• Continuous availability
• Security of transmissions
• Compatibility with all devices

12. Limitation of Liability

To the maximum extent permitted by law, The Drone Wave LLC is not liable for:

• Direct, indirect, incidental, or consequential damages
• Failure to deliver alerts
• Inaccurate or delayed location data
• Device or battery failure
• Service interruptions
• Any harm resulting from reliance on the App

Your use of the App is at your own risk.

13. Third‑Party Services

The App relies on third‑party providers such as Supabase, Firebase, Mapbox, and Google Sign‑In. We are not responsible for their performance or availability.

14. Termination

We may suspend or terminate your access at any time for violations of these Terms.

15. Governing Law

These Terms are governed by the laws of Texas, United States.

16. Changes to These Terms

We may update these Terms at any time. Continued use of the App means you accept the updated Terms.

These Terms of Use ("Terms") govern your access to and use of GPS Ghost ("the App"), operated by The Drone Wave LLC, doing business as Scintilla Dev ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Purpose of the App

GPS Ghost is a developer and QA testing tool designed to simulate GPS coordinates on Android devices. It enables developers, testers, and QA professionals to set mock locations, create test routes between waypoints, and simulate realistic device movement at configurable speeds — for the purpose of testing location-based applications, validating geofencing logic, debugging region-specific features, and verifying map integrations.

Intended Use: GPS Ghost is intended exclusively for legitimate software development, quality assurance testing, and educational purposes. The App leverages Android's built-in Developer Options mock location provider, which is a standard tool in the Android development ecosystem.

Prohibited Use: GPS Ghost is not intended and shall not be used for fraudulent, deceptive, or unlawful purposes, including but not limited to: manipulating location-based services for personal gain, circumventing geographic restrictions on commercial platforms, deceiving third-party applications or services, or any activity that violates applicable laws or the terms of service of third-party platforms. Any such use is a violation of these Terms and is undertaken entirely at the user's own risk.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your region) to use the App.

3. License & Usage

We grant you a limited, non-exclusive, non-transferable, revocable license to use GPS Ghost on your personal device.

GPS Ghost does not require an account. No login or registration is needed to use the app.

4. Subscriptions

GPS Ghost offers a Pro subscription (monthly, annual, and lifetime options) managed through RevenueCat and the platform's app store (Apple App Store or Google Play).

• Subscriptions auto-renew unless cancelled before the renewal date
• Cancellation and refund policies are governed by Apple or Google's respective terms
• A free trial period (3 days) is available; after the trial ends, a subscription is required for Pro features

5. User Responsibilities

By using the App, you agree that:

• You will use GPS Ghost only for legitimate development, testing, QA, and educational purposes
• You will not use the App to deceive, defraud, or mislead any person or service
• You will not use the App to manipulate or circumvent location-based services for personal or commercial gain
• You are solely responsible for how you use the App and any consequences arising from that use
• You will comply with all applicable local, state, national, and international laws and regulations
• You understand the App is a development tool and accept full responsibility for any use outside its intended purpose

6. Prohibited Conduct

You agree not to:

• Use the App for any unlawful, harmful, fraudulent, or deceptive purpose
• Use the App to manipulate location data on ride-sharing, delivery, dating, gaming, or similar commercial platforms
• Use the App to circumvent geographic restrictions, earn fraudulent rewards, or gain unfair advantages on any platform
• Attempt to reverse engineer, modify, or disrupt the App
• Redistribute, resell, or sublicense the App
• Use the App to violate the terms of service of any third-party platform

Any use of the App outside its intended purpose as a development and testing tool is strictly prohibited and constitutes a violation of these Terms.

7. Intellectual Property

All content, branding, software, and features of GPS Ghost are owned by The Drone Wave LLC or its licensors.

8. "AS IS" Disclaimer

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

We do not guarantee:

• Accuracy of mocked GPS data
• Compatibility with all devices or operating systems
• Continuous or error-free operation
• That GPS mocking will work with all third-party apps or services

9. Limitation of Liability

To the maximum extent permitted by law, The Drone Wave LLC is not liable for:

• Direct, indirect, incidental, or consequential damages
• Any consequences resulting from the use of GPS simulation features on your device
• Account suspensions, bans, or penalties on third-party platforms
• Device or software malfunctions
• Any loss resulting from reliance on the App
• Any misuse of the App outside its intended purpose as a development and testing tool

Your use of the App is at your own risk.

9.1 Indemnification

You agree to indemnify, defend, and hold harmless The Drone Wave LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the App; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any use of the App outside its intended purpose as a software development and QA testing tool.

10. Third‑Party Services

The App relies on third-party providers:

• Mapbox — for map rendering and route calculation
• RevenueCat — for subscription management

We are not responsible for the performance or availability of these services.

11. Termination

We reserve the right to discontinue or modify the App at any time. Since there are no user accounts, termination applies to the availability of the App itself.

12. Governing Law

These Terms are governed by the laws of Texas, United States.

13. Changes to These Terms

We may update these Terms at any time. Continued use of the App means you accept the updated Terms.
